We accept no liability (to the fullest extent allowed by law) for the accuracy of information contained on software packaging or on the website, which may contain technical inaccuracies or typographical errors. However, this provision does not affect your statutory rights and remedies.

These terms & conditions contain the whole of our agreement relating to your purchase, together with our website prices and contact details. They cannot be varied except where in writing and signed by a Director of The Defining Way Limited.
We will not be liable to you for any loss or damage caused by us, our employees or our agents in circumstances where:
(a) there is no breach of duty of care owed to you by us or by any of our employees or agents;
(b) such loss or damage is not a reasonably foreseeable result of any such breach;
(c) any increase in loss or damage results from breach by you of any of these terms and conditions; or
(d) such loss or damage relates to any business or non-consumer loss or damage including, without limitation lost data, lost profits and business interruptions.

If any part of these terms and conditions are declared void for unfairness pursuant to the Unfair Terms in Consumer Contract Regulations 1999, the remaining contract shall only continue to bind the parties if it is capable of continuing in existence without the unfair terms.

All designs, graphics and other artwork (including the selection and arrangement of text and graphics) is and remains the copyright of The Defining Way Limited, although permission is granted to you to electronically copy and hard-copy print portions of our website for the sole purpose of placing an order, reading the terms & conditions with more ease or using this website for your shopping. Any other use is strictly prohibited.

Price of goods and Currency

We reserve the right to alter prices to take into account forces beyond our control.

Payment and terms of sale

All goods supplied are for personal or business use only and are not to be sold or offered for re-sale.

We reserve the right to refuse to supply any person or company for any reason

Full title of ownership of goods will be passed to the purchaser once we have received your full payment for such purchases. However, you shall not obtain any right of copyright (or similar rights) in your purchase, of which any unauthorised use including copying, letting for hire or sale is strictly prohibited.

Credit and payment card safety
The Defining Way Limited and our secure payment service providers, use the latest technology to protect your credit and payment card information and do not release it to any outside organization. You can place your orders using secure encryption (the Internet standard for secure transactions) or you can fax or post your card information to us. Any losses sustained by the transmission of personal information by e-mail or Internet links shall be borne exclusively by you.

Secure Transactions
The Defining Way Limited endeavour to provide you with the safest and most secure shopping experience possible. Since offerings and technologies change, we reserve the right to change, modify, add or remove portions of our Privacy Policy or change our secure payment service provider at any time without prior notice.

Cancellation and Returns
You may cancel your order by informing us of this in writing any time up to seven days from the day after the day of delivery. Goods are to be returned to us at your expense in an unused, unopened, condition without the seals or wrapping being removed or broken. We will refund your money within 14 days of receipt of the goods or within 30 days of your cancellation, whichever is the earlier. Returned goods are to be accompanied by a note showing your name, the date of order and the order number, and should be forwarded to Customer Services at the address on our website contacts page. If you do not pay for the goods to be returned to us, a deduction will be made from your refund to cover our costs for collecting the goods. No returns will be accepted if there is any deviation from these Terms & Conditions.

The Defining Way Limited cannot accept responsibility for goods lost in transit after being sent back to us. The return of goods is the responsibility of the sender and we recommend sending them back by registered or recorded delivery.
 

Damaged or Defective Items
Should you receive a damaged or defective item from us, we will offer you a choice of:

  • A prompt replacement.
  • A full refund.
  • An alternative item of the same value.

However, you must return the damaged or defective product and this must be received by us within 30 days of delivery to you. You will not be charged any additional shipping or handling fees for replacement shipments. In order to return the product, please refer to the "Contact us" section and fill in the necessary details.

Out of Stock Items
All products are subject to availability. We will notify you by email of any delay to the dispatch of your order and in the event that the ordered items are likely to be delayed for more than 7 days, we will give you an opportunity to cancel the out of stock items.

Cookies
The Defining Way Limited do not use or plant "cookies" on your PC. However, our secure payments service providers use �cookies� and the information is used only to execute orders and payment.

Children
We do not knowingly collect personal data from children, as sales transactions are by credit and payment cards it is unlikely that data knowingly, will be collected from any persons under the age of 18. Our websites are not designed to attract children.

The Defining Way�s Data Protection & Security Policy and procedures fully meet the requirements of the Data Protection Act 1984. This means we will collect, use and retain accurate personal information only where this is required for business or legal reasons.
